Rules and Conditions

 

GENERAL CONDITIONS:

It is a condition of entry to the Swapmart that sellers:

  1. abide by the regulations listed below;
  2. acknowledge and declare that the Rotary Club of Scarborough, Western Australia (Inc) and its  servants, agents, members and representatives owes no duty of care, liability or responsibility in respect of the provision by the said Club of the Swapmart facility to any seller; and
  3. expressly indemnify and hold harmless the said Club in respect of any claim, demand, suit or whatsoever arising out of the occupation during the period of Swapmart of a car bay, or deemed bay, by a seller.

 

REGULATIONS:

  • Sellers are permitted entry to Licensed Area from 5.45am. Sellers with the "Regular Seller" Cards (no longer being issued) are permitted to enter at 5.30am.
  • Vehicle movement inside the Swapmart between 6.25am and 11.00am is prohibited. If a seller wishes to depart from the Swapmart before 11.00am, you should remove the vehicle from the Licensed Area by 6.25am and park the vehicle outside the Licensed Area.
  • Cars are not to be moved before 11.00am and once moving keep the speed of your vehicle to 5km per hour. Failure to do so will result in refusal of entry to the Swapmart in the future.
  • All sellers must exit the car park by 12.30pm.
  • Sellers must not exceed the space provided within the car bay(s) allocated, including encroaching more than 1 metre into the driveways between bays.
  • Sellers are responsible for leaving the bay exactly how they found it. Please take your unsold items and any rubbish with you. There is not a rubbish bin available for disposal of rubbish on the site.
  • Sellers waiting to access the Licensed Area are to line their vehicles up in an orderly fashion (see map on next page) respecting the immediate local community and the Shopping Centre tenants and their rights.
  • Parking is prohibited in the TAB allocated car-parking bays outside the Licensed Swapmart Area during the Swapmart operating hours.
  • Parking in areas marked by witch's hats is prohibited. Area is reserved for emergency access.
  • Holding of bays for late-comers is prohibited.
  • Unacceptable behaviour including the removal of goods from a bay prior to collection of fees and cooking of food will not be tolerated and may result in a seller being banned from the Swapmart.
  • Sellers are bound by the Department of Employment & Fair Trading Regulations as outlined on their receipt for payment. No food/drink, new or counterfeit goods are to be sold.  This is a requirement under the Retail Trading Hours Act (Temporary Markets) Exemption Order 1992.
  • Sellers are bound generally by rules of good sense and behaviour bearing in mind that the primary function of the Swapmart is to raise funds for charitable and worthwhile community purposes.
  • Sellers fee per bay (whether used for sale of goods or parking): $10.00
  • Buyers admitted at 6.30am and the entry fee is $1.00 per adult.  Children are admitted free of charge.
  • No pets allowed.
  • No Smoking within the enclosed area.
  • No power provided (there is one testing point next the entrance close to the food van).
